Terms of Service

Welcome to Catch & Release. By accessing or using our service, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By creating an account, accessing, or using Catch & Release, you agree to these Terms and our Privacy Policy. If you do not agree, you may not use our service.

2. Service Description

Catch & Release is a YouTube competitor tracking tool that:

  • Monitors publicly available YouTube channels you select
  • Identifies outlier videos based on performance metrics
  • Sends email alerts when videos show viral potential
  • Provides analytics and insights for content strategy

We reserve the right to modify, suspend, or discontinue any part of the service at any time.

3. Account Registration

3.1 Eligibility

You must be at least 16 years old to use Catch & Release. By registering, you represent that you meet this requirement.

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access
  • Providing accurate and current information

4. Subscription and Payment

4.1 Free Trial

New users receive a 7-day free trial. A valid payment method is required. If you don't cancel before the trial ends, you'll be charged on day 8.

4.2 Subscription Plans

  • Creator Plan: €71/month - Track up to 25 competitors
  • Pro Plan: €103/month - Track up to 75 competitors

4.3 Billing

  • Subscriptions renew automatically on a monthly basis
  • Charges occur on the same day each billing cycle
  • All fees are in Euros (€) and non-refundable except as stated in Section 4.5
  • You're responsible for all taxes

4.4 Price Changes

We may change subscription prices with 30 days' notice. Continued use after the notice period constitutes acceptance of the new price.

4.5 Refund Policy

30-Day Money-Back Guarantee: If you're not satisfied within the first 30 days of your paid subscription, contact us for a full refund. Refunds are not available after 30 days.

4.6 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. You will retain access until the end of the paid period.

5. Acceptable Use

5.1 Permitted Use

You may use Catch & Release solely for:

  • Legitimate content research and strategy
  • Tracking publicly available YouTube channels
  • Personal or business YouTube channel growth

5.2 Prohibited Activities

You may NOT:

  • Resell, sublicense, or share your account with others
  • Reverse engineer, decompile, or extract our source code
  • Use automated tools to scrape or collect data from our service
  • Violate YouTube's Terms of Service or any applicable laws
  • Harass, abuse, or harm other users or creators
  • Use the service for illegal or fraudulent purposes
  • Attempt to gain unauthorized access to our systems
  • Overload or interfere with our infrastructure

6. YouTube API and Third-Party Services

Catch & Release uses YouTube API Services. By using our service, you also agree to:

  • YouTube Terms of Service
  • Google Privacy Policy

We are not responsible for changes to YouTube's API, terms, or availability that may affect our service.

7. Intellectual Property

7.1 Our Rights

All content, features, and functionality of Catch & Release, including but not limited to software, algorithms, designs, logos, and trademarks, are owned by us and protected by copyright, trademark, and other laws.

7.2 Your Rights

You retain ownership of your account data. By using our service, you grant us a license to process your data solely to provide the service.

8. Data and Privacy

We collect and process data as described in our Privacy Policy. We are committed to GDPR compliance and protecting your information.

9. Disclaimer of Warranties

Catch & Release is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

  • Accuracy, reliability, or completeness of data
  • Uninterrupted or error-free service
  • Results or outcomes from using the service
  • Compatibility with YouTube's API changes

10. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for any indirect, incidental, special, or consequential damages
  • Our total liability shall not exceed the amount you paid in the 12 months prior to the claim
  • We are not responsible for content on YouTube or actions taken based on our alerts
  • We are not liable for service interruptions, data loss, or security breaches beyond our control

11. Indemnification

You agree to indemnify and hold harmless Catch & Release, its operators (Maxime Schuy, Christoph Herler, Max Sirota), and affiliates from any claims, damages, or expenses arising from:

  • Your violation of these Terms
  • Your use of the service
  • Your content or actions on YouTube
  • Your violation of any third-party rights

12. Termination

12.1 By You

You may terminate your account at any time by cancelling your subscription.

12.2 By Us

We may suspend or terminate your access immediately if:

  • You violate these Terms
  • Your payment fails
  • Required by law or YouTube's terms
  • We discontinue the service

12.3 Effect of Termination

Upon termination, you lose access to the service. We may delete your data after a reasonable period, subject to legal retention requirements.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the service. Continued use after changes constitutes acceptance of the new Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of Germany. Any disputes shall be resolved in the courts of Munich, Germany.

For EU residents: Nothing in these Terms affects your statutory rights as a consumer under EU law.

15. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Catch & Release.
